Terms of Service for Participants

By Enrolling to join a KGS’s Program, the Participant (“you”) accepts these Terms of Service (”terms”) as governing your relationship with KGS Technology Group, Inc (“KGS”, “we”, “us”, “our”). In these Terms of Service, “Program” means the period commencing and concluding with your placement and, where applicable, accompanying program curriculum and schedule of events. A “Host Company or Client ” means the organization with which you are placed after completion of a program or during a Program.

*All the discounted program will be considered as non refundable by default. It means if you have taken any discount on the program fee it will automatically become a non refundable program and follow the refund policy related to non refundable programs.

Career fields (Industry and/or Job Function): Technology & Engineering; Banking & Financial Services; Marketing, Healthcare; Pharmaceutical ;.E-commerce & Retail ; Automobile; Aerospace; Insurance; Manufacturing; Oil & Gas; Power & Energy ; Advertising & PR; Consulting & Professional Services; Start-ups & Entrepreneurship; The attribution of an Industry or Job Function category to a placement is made as per the applicant’s field of studies and at our sole determination.

Payment plans: We offer a variety of payment plans along with different payment modes to accommodate your needs. From monthly installments to smaller amounts over longer periods of time, these are just some of the options from which you can choose. None of our payment plans incur extra charges.

If you select the Pay Later plan, 50% of the Program Fee is payable during the time of program enrollment. The full balance of the Program Fee is payable before your marketing starts for placement or no later than 30 days from the scheduled start date of your Program, whichever is sooner.

Placement Deadline: For all the programs, the Placement Deadline is 90 days from the day we start marketing your profile followed by executing the Right to represent clause to determine exact date of placement deadline and refund window. Please note the “Your Co- operation” conditions set out below.

Program Fees, Enrollment & Placement Processes

Program Fees: The Program fees consists of two components. Preparation Fee and Placement Fee. Preparation Fee: This is the nominal fee we collect against the efforts aimed at making you market ready including training , professional resume writing , technical and behavioral grooming, except as set out in the Placement Guarantee, is non-refundable.

Placement Fee: Any fee outside the preparation fee is considered as placement fee which is $300.


Our programs are extremely competitive, so we recommend submitting your deposit at your earliest to ensure that you’ve confirmed a spot on the program. Fill out our short Enrollment Form and submit your resume/CV to our human Resource team. You will then be taken to our event calendar to schedule your preferred time with our Team to take you forward with the program.


The placement matching process will commence following the completion of your grooming. During the placement matching process, you will have the opportunity to meet (virtually) with placement advisor and dedicated team of recruiters who will match you with prospective Host Companies before accepting any placement offers. You will be provided a limited time to accept (or decline) placement offers.

Our Responsibilities

Placement guarantee: We will match you with a placement with a Host Company in your primary or secondary preferred Location and primary or secondary Placement Field, each to be determined During the Evaluation and Gap Analysis phase of your Program on or before the Placement Deadline. Though we may consider and attempt to meet any other preferences that you may express during your Program or any time thereafter we are not obliged to do so.

In the unlikely event that we were not able to match you a placement with a Host Company in your primary or secondary Location and primary or secondary Placement Field on or before the Placement Deadline, in circumstances where we deem at our sole discretion you have given full co-operation, you will be entitled to cancel your participation in a Program and receive a refund of Placement Program Fees paid as set out in the Cancellation and Refunds section below.

Cancellations & Refunds Policy

Our cancellation and refund policy is designed to fully protect you from financial risk in circumstances where, despite your good faith, commitment to- and full co-operation during the enrollment and placement processes, we have not been able to place you in your preferred program options . In which case, we commit to protecting you by assuming all the financial risk via our Placement Guarantee.

Cancellation By you:

  • We offer full refund of your program fee within 3 days of your enrollment with no questions asked if you have not engaged with any of our services during this period. No claims will be entertained after 3 days of enrollment. As all our services are online based and intangible services, we will not entertain any claims like Item not received or item not matching the description. If you don’t like our service, you have to let us know within 3days of your enrollment else upon acceptance, buyer has received the immediate benefit of service reserved solely for its benefit and use hence not eligible for any claim/refund.
  • If you wish to cancel your participation in the program after the Placement Deadline, in circumstances where in our sole discretion you have given full co-operation, you will be eligible to defer your participation in a program to a later date or claim a full refund of the placement fees paid to us.
  • Naturally, our cancellation and refunds policy must also protect us from financial risk in circumstances where you choose to engage our services by enrolling, and thus cause us to commit finite resources and incur costs on your behalf. In a situation like this, if you choose to issue a refund for reasons outside our control, we are not liable to refund any part the fee that you have paid.
  • Whatever the reasons, we are not responsible for reimbursing to you any travel or other costs that you may have incurred with respect to our program.
  • We want you to enjoy a worry-free Program. Should you experience any problems while participating in our Program or dissatisfaction with Our services, you must immediately inform us in writing (by email to support@kgstechgroup.com), with a clear explanation of the problem. Upon receiving your written request, we will discuss the problem with you and find ways in which the problem can be solved. You agree to communicate in written and discuss any problems with your Program with our staff or placement advisor prior to cancelation of the program. In such event, if KGS is unable to provide a solution, you are eligible for a full refund of your Placement Fee. We shall not bear any responsibility unless your problem is communicated to us in writing, by email within 48 hours it stated. You understand and accept that failure to adhere to this clause, KGS reserves the right to terminate Your participation on the program with immediate effect with no refund.
  • For all refundable programs mentioned above, a written requests for refunds not received within 7 days after the program deadline at support@kgstechgroup.com will be forfeited. No refund request before the program deadline will not entertained.
  • Refund policy is not applicable for all the non refundable programs listed above.
  • All our non refundable programs are a continuous effort which company will be putting to secure the committed deliverables to the buyer. However, company does not take any responsibility of the outcomes of the program, and this has been clearly conveyed to the buyer. Within the program duration, the buyer will not, under any circumstances, claim or threaten to claim any chargebacks to the Company or to the buyer’s credit card and/or form of payment (ie, Stripe, PayPal) for any reason whatsoever related to the Program. Acknowledging this risk buyer has decided to pay and avail the program benefits.

Cancellation by Us: We may decline any application without stating our reasons. If during the placement process, we determine in our sole discretion that you are not fully co-operating or behaving suitably (note the “Suitable behavior during a program” and “Co-operation” conditions set out in the “Your Co-operation” section below) , we reserve the right to cancel your participation in the Program and retain the whole of any fees that you have paid. If during the placement process, we discover that any information that you have provided to us is inaccurate or untruthful in a way that we consider is material to the decision to offer you enrollment or a placement, we reserve the right to cancel your participation in the Program and retain the whole of any fees that you have paid.

Your Co-operation:

  • You acknowledge that any action that may detriment our ability to match you with a Host Company and/or prepare for your attendance of a Program (including, but not limited to, failure to respond to communications in a timely manner, failure to schedule appointments in a timely manner for each pre placement events , failure to attend scheduled appointments, failing to attend scheduled training , rejection of interview requests or placement offers matching your Program Option selections, failure to pay fees in a timely manner or otherwise impeding or delaying any pre-program processes without reasonable cause) may in our sole discretion be treated as lack of co-operation and nullify any entitlement to a refund of any fees paid as set out in the Cancellation and Refunds section above.

  • You agree that you will behave in a suitable manner towards Host Companies, their staff, other Participants and our staff during and in preparation for a Program. We reserve the right to terminate your participation in the Program if in our sole discretion your behavior subjects Host Companies, their staff, other Participants, our staff or us to any derogatory treatment or brings or has the potential to bring Host Companies, their staff, other Participants, our staff or us into disrepute.
  • Comply with the instructions provided by KGS staff, Our partners and/or subcontractors. Improper interference with the functioning of the program that deviates from the accepted professional or ethical standards will be regarded as misconduct. This also includes not following the terms, conditions and rules set by Our partners.
  • Communicate clearly with KGS about Your placement preferences and understand We will endeavor to find a suitable match based on your communicated preferences during the Evaluation and Gap analysis process. Utilise all the resources and support provided by Us in the lead up to Your interview, placement, during the program and post-program, including thoroughly reading all documents supplied to You.
  • Must be free and available to fulfil placement requirement as stated on your Enrollment form. Liaise with KGS to ensure sufficient documentation and support is provided to assist with Your placement program. For the avoidance of doubt, we expect all documents requested to be submitted within 3 days from the date of enrollment.
  • Reply in a timely manner to all correspondence issued by KGS. For the avoidance of doubt, we expect a response within 48 working hours. Attend Training , technical mock, interviews and complete any tasks requested by the host company, on time. Work with Us in a timely manner to attend any necessary telephone or online interviews as required by Us or a host company.
  • Non-attendance/Late Arrival/Early Termination: Whatever the reasons, if you are not attending the scheduled event, late in arriving for an event in the Program, leaving early from any event of the program or quit the Program before the program has finished, we will not make any full or partial refund of fees paid nor write off any fees outstanding.

Data Protection

It is in the nature of your relationship with us that you will supply us with personal data and you consent to us making such information available to prospective Host Companies, reference checking service providers, regulatory authorities, and governmental or quasi-governmental organizations.

Your Rights

You may ask us not to process your personal data for marketing purposes. You have the right to ask us to provide information in writing about your information that we hold. You may ask us to remove your information from our database records. You may exercise all or any of these rights by making written electronic application to our nominated representative.

You acknowledge and consent to us collecting information about you (including electronic information that may be used to help identify you including but not limited to your IP address and the electronic device(s) you used to apply) and that this information may be used to help identify, prevent, and report fraud.


No amendment, alteration, or modification of any of the provisions of these terms shall be effective unless made in writing and signed by both parties.

Sales Tax/Value Added Tax

All fees are stated exclusive of any applicable Sales Tax or Value Added Tax (VAT). We will provide a receipted tax invoice on payment of all fees due upon request.


We will not discriminate without lawful cause against any person, nor victimize or harass them, on the grounds of: race or racial group (including color, nationality and ethnic or national origins); sex (including marital status, gender reassignment, pregnancy, maternity and paternity); sexual orientation (including civil partnership status); religion or belief; age; or disability. We will take such steps, and make such adjustments, as are reasonable in all the circumstances in order to prevent persons who are disabled from being placed at a substantial disadvantage in comparison with those who are not disabled.

Third Party Costs

Whether a Program is cancelled by you or by us, in no circumstances will we be liable to reimburse any costs or expenses that you may have incurred in connection with your participation in the Program. In circumstances where you are entitled to a refund, we will only be liable to refund the whole or part of what has been paid to us.


These Terms of Service shall be governed by and construed in accordance with the Laws of the State of Georgia whose Courts shall be the courts of competent jurisdiction. You irrevocably agree to submit the exclusive jurisdiction of the courts of State of Georgia over any claim or matter arising under or in connection with these Terms of Service.
